Terms of Service

Welcome to TideMy. By creating an account or using any part of the TideMy platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
These Terms are intended to address the use of AI-enabled creative tools, social media automation, and connected third-party platform publishing. If you use TideMy on behalf of a business or other organisation, you agree to these Terms for that entity and represent that you have authority to bind it.
Certain parts of the Service are public or community-facing. Content you post to public profiles, feeds, discovery pages, template libraries, showcases, examples, or other public areas may be viewed, copied, remixed, reused, reposted, saved, shared, adapted, and redistributed by other users, and may also be accessible to visitors, search engines, and third parties outside our control.
1. Eligibility and Acceptance of Terms
These Terms constitute a legally binding agreement between you (“User”) and TideMy (“Company”, “we”, “us”). You must be at least 16 years old to use the Service, and you must be at least 18 years old to use any feature involving synthetic avatars, voice cloning, likeness replication, or other restricted AI-generated media where consent, publicity, consumer protection, or platform rules require adult capacity. By using the Service, you represent that you are legally able to enter into these Terms and that your use complies with applicable law.
2. Description of Service
TideMy is a web-based content automation platform that allows users to:
- Create, edit, and manage social media posts, slideshows, marketing assets, and short-form videos.
- Generate or transform text, images, audio, voiceovers, avatars, AI UGC-style videos, and other synthetic or edited media using machine learning or generative AI tools.
- Schedule and automatically publish content to connected TikTok and Instagram accounts and other supported third-party platforms.
- Publish content to public profiles, feeds, discovery pages, showcases, example galleries, template libraries, or other community surfaces where it may be visible and reusable by others.
- Manage a media library and content calendar.
We reserve the right to modify, suspend or discontinue any feature at any time with reasonable notice. Some features may be offered in beta, may depend on third-party providers or APIs, and may be changed, limited, or withdrawn without liability where reasonably necessary for security, legal, operational, or platform-compliance reasons.
Do not submit or designate content as public if you want it to remain private, confidential, limited to a small audience, or exclusive to you.
3. Account Registration
- You may sign in using your Google account. You are responsible for maintaining the security of your Google credentials.
- You must provide accurate information and keep it up to date.
- If you use public features, your username, display name, handle, avatar or profile photo, bio, public metrics, and published content may be displayed publicly in connection with your account and content.
- One person or entity may not maintain more than one free account.
- You are responsible for all activity that occurs under your account.
- You must promptly notify us of any suspected unauthorised access, token compromise, misuse of connected social accounts, or security incident relating to your account.
- We may require additional verification, information, or proof of rights before enabling certain features or restoring access.
4. Fees, Subscriptions, and Billing
Certain features of the Service may require a paid subscription. Unless otherwise stated, subscriptions renew automatically for the same billing cycle until cancelled. You authorise us and our payment processors to charge the applicable fees, taxes, and any valid usage- based charges using your chosen payment method.
Pricing, billing cycles, trial terms, and refund eligibility are described on the applicable pricing page, checkout flow, or order form. We may suspend paid features for non-payment, failed charges, suspected fraud, chargebacks, or abuse. We may change pricing with at least 30 days’ prior notice for future billing periods.
5. User Content, Inputs, Outputs, and Commercial Use
5.1 Ownership and responsibility
You retain any rights you already hold in content, prompts, instructions, media, account data, profile information, and other materials you upload, connect, submit, generate, or otherwise provide through the Service (“Inputs”, “User Content”, and, where applicable, “Outputs”). Subject to your compliance with these Terms and applicable law, you may use Outputs generated for you by the Service for lawful personal or commercial purposes.
Outputs may not be unique, may resemble content generated for other users, and may not be eligible for copyright, neighbouring rights, or other intellectual property protection in every jurisdiction. TideMy does not transfer ownership of the Service, underlying models, prompts infrastructure, software, workflows, templates, or any TideMy intellectual property.
5.2 Licence you grant TideMy
When you upload, submit, generate, publish, display, transmit, or otherwise make available any Inputs, User Content, Outputs, public profile information, usernames, handles, avatars, biographies, captions, prompts, comments, tags, template elements, or related materials through the Service, you grant TideMy and its affiliates, service providers, successors, assigns, and sublicensees a worldwide, non-exclusive, sublicensable, transferable, royalty-free, fully paid-up licence to host, store, cache, reproduce, copy, process, format, transcode, modify, adapt, edit, translate, create derivative works from, distribute, transmit, communicate, publish, publicly perform, publicly display, make available, analyse, use, and otherwise exploit such materials in any media and formats now known or later developed to operate, provide, improve, secure, moderate, troubleshoot, enforce, promote, market, advertise, and showcase the Service and its community, and to make Public Content available as contemplated by these Terms.
This licence survives for as long as necessary to provide the Service and, after removal or deletion, to the extent reasonably necessary for backups, logs, legal compliance, dispute resolution, enforcement, security, copies already shared with others, or materials created or distributed before removal. To the maximum extent permitted by applicable law, you waive and agree not to assert any moral rights, rights of attribution, or similar rights that would prevent the uses expressly authorised by these Terms.
Where applicable law requires separate consent for particular testimonial, endorsement, or advertising uses of your name, likeness, voice, or similar identifiers, TideMy may request that consent separately and may limit those uses unless and until it is obtained.
5.3 Public Content and community features
Certain features of the Service are public or community-facing, including public profiles, feeds, discovery pages, examples, template libraries, showcases, galleries, comments, or other areas visible beyond your private workspace (“Public Areas”). Any User Content, Outputs, profile information, usernames, display names, handles, avatars, bios, captions, prompts, comments, tags, metrics, or related materials that you submit to a Public Area or otherwise designate as public is referred to in these Terms as “Public Content.”
By making content Public Content, you instruct TideMy to publish it and you grant each user of the Service a worldwide, non-exclusive, royalty-free licence to access, use, copy, reproduce, distribute, display, perform, publish, share, save, remix, adapt, modify, translate, create derivative works from, and otherwise exploit that Public Content for personal or commercial purposes, subject to these Terms and applicable law. You agree that Public Content may appear in profiles, feeds, recommendations, search results, discovery pages, examples, case studies, emails, advertisements, template libraries, showcases, social channels, and other online or offline media used in connection with the Service.
Public Content is not confidential and may not remain private, exclusive, or removable from every location. Other users, visitors, search engines, developers, and third parties may copy, cache, archive, mirror, screen-capture, download, reshare, repost, quote, transform, or otherwise reuse Public Content, including after you delete it or close your account, and TideMy is not responsible for those uses to the extent permitted by applicable law.
5.4 Visibility settings and clearances
Where the Service offers private, limited, or public visibility settings, you are responsible for selecting the appropriate setting. If you enable a public profile, publish to a Public Area, submit content to a public template or example library, or otherwise designate content as public, you represent and warrant that you have all rights, permissions, releases, notices, lawful bases, and other authorisations necessary to do so and that you consent to TideMy displaying and associating your username, display name, handle, profile photo or avatar, bio, account identifiers, captions, prompts, tags, engagement metrics, and related content or metadata with that Public Content.
You are solely responsible for ensuring that your Inputs, User Content, Public Content, Outputs, profile information, and use of the Service do not violate any applicable law, contract, platform rule, or third-party right, including copyright, trademark, trade secret, privacy, data protection, publicity, personality, biometric, consumer-protection, advertising, confidentiality, or defamation rights.
6. AI Features and Output Disclaimers
The Service uses automated systems and generative AI. Outputs may be inaccurate, incomplete, misleading, offensive, biased, non-compliant, non-unique, or infringing, and may contain errors, hallucinations, or synthetic elements that require human review before publication or reliance.
You must review, edit, verify, and approve all Outputs before using, publishing, distributing, or relying on them. You must not rely on the Service for legal, medical, financial, employment, political, safety-critical, or other high-risk decisions. TideMy does not guarantee that any Output is accurate, lawful, non-infringing, available for protection, or fit for any particular purpose.
Public Content and Outputs made available by other users may be AI-generated, edited, synthetic, misleading, incomplete, or unlawful. TideMy does not endorse, verify, or pre-screen every item of Public Content and is not responsible for how other users interpret, reuse, or rely on it.
7. Synthetic Media, Likeness, Voice, and Disclosure Requirements
You may not use the Service to create, upload, generate, publish, or distribute synthetic, manipulated, or AI-generated media that impersonates, imitates, misrepresents, or falsely suggests the endorsement, speech, conduct, affiliation, or identity of any real person, business, brand, public figure, or government authority.
- You represent and warrant that you have obtained all notices, consents, releases, licences, permissions, and other rights needed to use any name, image, likeness, face, body, voice, signature, persona, biometric characteristic, personal data, or copyrighted material included in any Input, User Content, or Output.
- You must maintain records of such permissions and provide them to us upon request where reasonably necessary to investigate a complaint, comply with law, or satisfy a platform requirement.
- You must comply with all disclosure, labelling, provenance, endorsement, election, consumer protection, advertising, and AI transparency obligations that apply to synthetic or manipulated content in the jurisdictions where content is created, targeted, distributed, or viewed.
- Non-consensual deepfakes, deceptive avatars, voice cloning without authorisation, fake testimonials, false endorsements, romantic scams, fraud, voter suppression, political deception, or any use of the Service to mislead others about whether content is real, authentic, independently created, or endorsed are prohibited.
8. Acceptable Use
You agree not to do any of the following, and you must comply with any community guidelines, submission rules, or feature-specific policies we publish:
- Upload, post or transmit any content that is unlawful, hateful, harassing, defamatory, obscene, exploitative, fraudulent, misleading, or infringes any third-party intellectual property or personal rights.
- Upload, publish, or make public any content containing another person's personal data, confidential information, likeness, voice, or other protected material without all required rights, notices, lawful bases, and permissions.
- Use the Service to distribute spam, malware or conduct phishing campaigns.
- Generate, distribute, or schedule deceptive advertising, fake reviews, undisclosed sponsored content, fraudulent offers, or false or unsubstantiated claims relating to products, services, performance, earnings, health, finance, politics, or public events.
- Circumvent, disable or interfere with security-related features.
- Access the Service through automated means (bots, scrapers) except via the official API with our prior written consent.
- Use the Service to scrape, harvest, infer, profile, or collect personal data, credentials, or platform data unlawfully or beyond the permissions granted by applicable law, platform rules, or the relevant data subject.
- Violate TikTok’s or Instagram’s terms of service or community guidelines through content you publish via TideMy.
- Use Public Content obtained through the Service in a manner that violates any law, these Terms, or any third-party right, including by falsely implying endorsement, authorship, affiliation, or exclusivity.
- Create or distribute sexually exploitative content, child sexual abuse material, non-consensual intimate imagery, extremist content, or content that promotes violence, self-harm, terrorism, or illegal activity.
- Remove, obscure, or falsify any provenance, attribution, disclosure, watermark, or rights-management information where such information is required by law, platform rules, or the Service.
- Use the Service for account farming, fake engagement, engagement pods, fake followers, fake views, bulk or coordinated inauthentic activity, or any other manipulative social media practice.
- Reverse engineer, probe, benchmark, copy, or build competing models or services from the Service except to the extent such restriction is prohibited by applicable law.
- Resell, sublicense or offer the Service as a white-label product without a separate written agreement.
9. Social Media Automation and API Compliance
If you connect a third-party platform, social account, or API, you authorise TideMy to act on your instructions to publish, schedule, retrieve, format, transmit, or manage content on your behalf. You are solely responsible for complying with all terms, rules, disclosures, rate limits, developer policies, monetisation rules, community guidelines, and access restrictions that apply to those services.
You must not use the Service to bypass platform safeguards, evade moderation, automate prohibited behaviour, create or control multiple accounts in violation of platform rules, or generate fake engagement, fake identity signals, or deceptive activity. We may suspend or disable integrations, tokens, queues, or publishing functionality at any time if required by platform rules, legal obligations, security concerns, abuse signals, or a reasonable risk assessment.
10. Moderation, Investigation, and Enforcement Rights
We may, but are not obligated to, monitor use of the Service for compliance with these Terms, security requirements, legal obligations, and platform rules. We may investigate suspected misuse and take any action we reasonably consider necessary, including removing content, refusing prompts, blocking Outputs, applying labels or disclosures, requesting proof of identity or rights, suspending features, disabling integrations, freezing scheduled publishing, or suspending or terminating accounts.
We may preserve, review, and disclose relevant information where reasonably necessary to enforce these Terms, respond to complaints, protect users or third parties, satisfy platform obligations, or comply with law, court orders, or government requests.
We may operate reporting, flagging, notice, and removal processes for copyright, trademark, privacy, impersonation, safety, consumer-protection, or other policy concerns. If we make such tools available, you may use them or contact us at legal@tidemy.com. We may remove, disable, geo-block, age-gate, label, de-rank, or restrict access to content or profiles at our discretion, subject to applicable law.
11. Copyright Complaints and Repeat Infringers
If you believe content available through the Service infringes your copyright or other intellectual property rights, send a notice to legal@tidemy.com with: (a) identification of the protected work; (b) identification of the allegedly infringing content; (c) your contact details; (d) a statement of good-faith belief that the use is not authorised; and (e) a statement, under penalty of perjury where required by law, that the notice is accurate and that you are authorised to act.
We may remove or disable access to allegedly infringing material, notify the affected user, request additional information, and, where appropriate, permit a counter-notice process. We may terminate repeat infringers or users who repeatedly violate third-party rights.
If you believe content, a profile, or other activity on the Service violates privacy, publicity, impersonation, consumer-protection, or other non-copyright rights, you may also report it through any tools we make available or by contacting us at legal@tidemy.com. We may request supporting information, disable access pending review, or take any other action we reasonably consider appropriate.
12. Third-Party Services and Platforms
The Service may depend on third-party services, model providers, hosting providers, payment processors, and social media platforms that we do not control. Their availability, functionality, content rules, developer policies, fees, or API terms may change at any time. TideMy is not responsible for the acts, omissions, outages, moderation decisions, policy changes, or security failures of third-party services except to the extent required by applicable law.
13. Privacy and Data Processing
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You instruct TideMy to process Inputs, User Content, connected account data, publishing instructions, and related usage data as necessary to provide the Service, maintain security, investigate abuse, comply with law, and otherwise as described in these Terms and the Privacy Policy.
You must not upload or process personal data, sensitive personal data, biometric data, or special-category data through the Service unless doing so is lawful, necessary, and accompanied by all required notices, permissions, lawful bases, and safeguards. If you use the Service for business purposes, you remain responsible for your own privacy notices, lawful bases, marketing disclosures, and any controller, business-user, or employer obligations that apply to your use.
If you choose to use public or community features, you instruct TideMy to process and disclose your Public Content and associated profile information to other users and the public as necessary to provide those features. You acknowledge that public disclosure may involve international access, further copying, reuse, and republication by others outside our control.
14. Intellectual Property
The TideMy platform, brand, software, workflows, documentation, templates, designs, interfaces, compilations, and associated intellectual property are owned by TideMy or its licensors and are protected by copyright, trademark, trade secret, database, and other laws. Except for the limited rights expressly granted to you in these Terms, no licence or right is granted by implication, estoppel, or otherwise.
15. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless TideMy, its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any claims, demands, actions, proceedings, liabilities, damages, losses, judgments, settlements, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to: (a) your Inputs, User Content, Public Content, Outputs, profile information, or published content; (b) your use of the Service, Public Areas, or connected third-party platforms; (c) your breach of these Terms or applicable policy requirements; (d) your violation of applicable law, regulation, platform rules, or third-party rights; (e) any allegation that the hosting, display, distribution, remixing, marketing, reuse, or other exploitation of content you submitted, generated, or made public through the Service infringes or misappropriates any intellectual property, privacy, publicity, personality, biometric, confidentiality, consumer-protection, or other right; or (f) any dispute between you and another user or third party regarding authorship, ownership, permission, disclosure, consent, compensation, attribution, or reuse of Public Content.
16. Disclaimer of Warranties
The Service is provided “as is” and “as available” without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or results. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that Outputs will be lawful, unique, protectable, or accepted by any social media platform, regulator, advertiser, marketplace, or audience. We do not warrant that Public Content will remain private, exclusive, available, removable, or free from copying, misuse, or access by others.
17. Limitation of Liability
To the maximum extent permitted by law, TideMy shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from or relating to (a) your use of or inability to use the Service; (b) any Outputs, published content, or third-party platform actions; (c) unauthorised access to your account; (d) loss of platform access, distribution, reach, monetisation, rankings, or audience engagement; (e) content moderation, removal, labelling, or suspension decisions; or (f) any copying, sharing, reuse, remixing, redistribution, republication, monetisation, or other use of Public Content by other users or third parties.
To the maximum extent permitted by law, TideMy’s aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of: (i) the total amount you paid to TideMy for the Service during the 12 months preceding the event giving rise to the claim; or (ii) USD $100 if you have not paid any fees to TideMy. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
18. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend, restrict, disable, or terminate your access to the Service, specific features, or connected integrations immediately, with or without notice, if we reasonably believe that: (a) you breached these Terms; (b) your use creates legal, regulatory, reputational, security, or platform risk; (c) you failed to pay amounts due; (d) we are required to do so by law or a third-party platform; or (e) your use may cause harm to TideMy, users, third parties, or the public.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination, including those relating to ownership, licences, payments, indemnification, disclaimers, limitation of liability, dispute resolution, and enforcement, will survive. Data handling following termination will be governed by the Privacy Policy and any applicable law. Termination or removal will not require deletion of copies, remixes, or other uses of Public Content already made by other users or third parties in accordance with these Terms or outside our control.
19. Governing Law and Dispute Resolution
Before filing a formal claim, you agree to notify us at legal@tidemy.com and attempt in good faith to resolve the dispute informally for at least 30 days, unless urgent injunctive relief is necessary. Except where mandatory consumer or data protection law provides otherwise, these Terms are governed by the laws of the jurisdiction in which the TideMy entity contracting with you is incorporated and has its principal place of business, without regard to conflict-of-law principles.
Subject to any non-waivable rights you may have under applicable law, the courts located in that jurisdiction shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. Nothing in these Terms prevents either party from seeking injunctive or equitable relief for misuse of intellectual property, confidential information, the Service, or connected platforms.
20. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or an in-app notice at least 14 days before they take effect, unless a shorter period is required for legal, security, or platform-compliance reasons. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
21. Miscellaneous
You may not use the Service if you are subject to trade sanctions or export restrictions that prohibit such use. We are not liable for any delay or failure caused by events beyond our reasonable control, including outages, cyberattacks, labour disputes, natural disasters, platform restrictions, or failures of third-party providers. These Terms constitute the entire agreement between you and TideMy regarding the Service unless superseded by a separate written agreement. If any provision is held unenforceable, the remaining provisions will remain in effect.
